Terms of Service

Last updated: November 4, 2026

These terms govern your use of usefirstbrief.com and the FirstBrief DM Booking service ("FirstBrief," "we"), operated by RavineRoad Enterprises LLC. By using the site or purchasing the service, you agree to these terms.

1. The service

We install and operate an AI setter inside your Instagram DMs (and, on the Growth tier, Facebook Messenger): instant replies, buyer qualification, in-chat booking, 14-day follow-up, and human handoff of hot or complex threads. You get a weekly scoreboard: handled, qualified, booked, showed.

Week 1 is draft-only. Nothing goes to your customers unsupervised until you've approved the reply style. After that, anything outside the approved answer book escalates to you instead of improvising.

The setter identifies as AI. It never claims to be human, per California's B.O.T. Act and our own policy.

2. Your responsibilities

3. Account access

You grant us limited, revocable access to read and reply to DMs on the connected account, solely to perform this service. We will not post, follow or unfollow accounts, or change your profile. Access ends automatically when the engagement ends.

4. Fees and payment

5. Data and confidentiality

Your customer conversations are confidential. We act as your service provider under California privacy law: we process DM content only on your instructions, never sell it, never use it to train models for anyone else, and delete operational access within 30 days of termination (accounting records kept per law).

6. Acceptable use of this site

Don't misuse the site: no scraping, no automated harvesting of content, no attempting to disrupt the service, and no misrepresenting your identity when contacting us.

7. Intellectual property

The site's content — copy, design, and media — belongs to FirstBrief / RavineRoad Enterprises LLC. The answer book and conversation flows we build for you are handed over to you if the engagement ends.

8. Liability

AI can make mistakes — that's why week 1 is draft-only and escalations exist. Our total liability is capped at the fees you paid in the 3 months before the claim. Neither side owes the other indirect or consequential damages.

9. Term and termination

Month-to-month after the pilot. Either side can end with 14 days' written notice (email counts). We hand over the answer book and flow documentation we built for you on exit.

10. Governing law

California. Disputes first go to good-faith negotiation for 30 days, then mediation in San Diego County.

11. Changes to these terms

We may update these terms; the "Last updated" date will change and material changes to the service terms will be communicated to active clients by email before they take effect.
